These terms constitute a legally binding agreement between you ("User", "you") and BCM Transform (Pty) Ltd ("BCM Transform", "we", "us").

• Operational process automation (BCMFlow)
• Rapid product validation (BCMLabs)
• Technology consulting and strategy (BCMVision)
• Data and analytics platforms (BCMInsight)

The Site provides information about these services and facilitates contact between potential clients and our team.

3. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, images, illustrations, software, and design — is the property of BCM Transform (Pty) Ltd or its licensors and is protected by South African and international copyright, trademark, and intellectual property laws.

To the fullest extent permitted by law, BCM Transform disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

6. Limitation of Liability

To the maximum extent permitted by applicable law, BCM Transform and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site, including but not limited to loss of profits, data, goodwill, or business opportunity.

Our total aggregate liability for any claim arising from or relating to these Terms or the Site shall not exceed the amount paid by you, if any, to BCM Transform in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including the Consumer Protection Act 68 of 2008 (South Africa).

7. Indemnification

You agree to indemnify, defend, and hold harmless BCM Transform and its directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Site, your violation of these Terms, or your infringement of any third-party rights.

8. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by BCM Transform. We are not responsible for the content, privacy policies, or practices of any third-party sites. Inclusion of a link does not imply endorsement.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Gauteng, South Africa (Pretoria division).

For US and Canadian users: Nothing in these Terms is intended to waive any rights you may have under mandatory consumer protection laws in your jurisdiction, including the CCPA/CPRA (California), PIPEDA (Canada), or Quebec Law 25.

10. Termination

We reserve the right to restrict, suspend, or terminate your access to the Site at any time, without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Site ceases immediately.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
